Simple terms, plainly put.

These terms cover buying and using Atlas, a native macOS app sold by THEODOREHQ. They are written to be readable, and they never take away the rights UK consumer law gives you. Where the law says something different, the law wins.

Your licence

When you buy Atlas you receive a non-exclusive, non-transferable licence to install and use it on up to three Macs that you personally own or use. Your purchase covers the major version you buy plus every update released within that version, for as long as you use it. There is no subscription; it is a one-time purchase.

What you may not do

Price and payment

Atlas is a one-time purchase of $9.99. Payment is handled by Polar.sh, who act as the merchant of record. That means Polar calculates, collects and remits any sales tax or VAT due in your country, so the price you see at checkout is the price you pay. Your card details are handled by Polar and never touch our servers.

Your 14-day right to cancel

Because Atlas is a digital product sold at a distance, you normally have 14 days to cancel for any reason under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Digital products are a special case: we can only deliver your licence key immediately if you agree to give up that 14-day right. So, at checkout, you are asked to confirm:

I want immediate access to my licence key and I accept that, by doing so, I lose my 14-day right to cancel.

This is separate from your statutory rights below, which always apply.

Your statutory rights (Consumer Rights Act 2015)

Under the Consumer Rights Act 2015, the digital content you buy must be of satisfactory quality, fit for purpose, and as described on this website. If it is not, you are entitled to repair, replacement, a price reduction or a refund as the law provides. These statutory rights override anything in this document, and nothing here removes them.

Product updates and newsletter

By purchasing Atlas, you consent to receive our occasional customer newsletter at the email address used at checkout. This is a "soft opt-in" under Regulation 22(3) of PECR, which permits direct marketing of similar products to existing customers. At checkout, an unticked box lets you opt out without affecting your purchase, and you can unsubscribe with one click from any email.

App updates

Atlas checks for updates through Apple's Sparkle framework and installs them with your permission. Updates within your major version are included free. You can disable update checks in Settings at any time.

Limitation of liability

To the extent the law allows, our total liability to you for any claim connected with Atlas is limited to the amount you paid for your licence. We do not limit or exclude liability for fraud, for gross negligence, for death or personal injury caused by negligence, or for anything else that UK law does not permit us to limit, including your statutory rights under the Consumer Rights Act 2015.

Ending your licence

We may revoke a licence if it was obtained by fraud, if a chargeback is raised without contacting us first to resolve the issue, or in the case of a wilful breach of these terms (for example, distributing your key). We will always try to reach you first. If you simply stop using Atlas, nothing happens; your data is already only on your Mac.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. Nothing here removes any right you have to bring proceedings in the country where you live, if your local consumer-protection law gives you that right.

Changes to these terms

If we change these terms we will update the date at the top and, for material changes, email active customers at least fourteen days before they take effect. Changes that reduce your rights do not apply retroactively to purchases already made.
